This Give Away is conducted/sponsored by ASICS Runner App, Inc. d/b/a Runkeeper (“Runkeeper” or “ASICS ”).
ENTRY:
The Campaign is open to Runkeeper users who are selected by the Runkeeper Marketing team as highly active users (excluding Directors, officers, management, employees, other staff and immediate family and household members of those individuals of ASICS or ASICS offices in the participant countries) who are residents of Japan, and at least 18 years of age (each, a “Recipient”).
PRIZES:
Recipients will be randomly selected by ASICS Runkeeper employees via software, and once verified each winner will be awarded one (1) bib to the 2023 Tokyo Marathon (“the Race”) on March 5, 2023 (25,300JPY ARV). The Recipients will be notified via email to the email address associated with their OneASICS account, if notified you have 3 business days to accept the gift, otherwise ASICS Runkeeper will reselect another recipient. The email will contain instructions on how to obtain the gift. The Recipients will be notified on or before November 21, 2022. If you do not receive an email indicating you were selected, you will not be gifted a bib.
Recipients must complete the application process for participation in the Race on their own.
Recipients must meet the eligibility requirements for the Race. Please refer to the Tokyo Marathon 2023 official website for eligibility requirements.
The Tokyo Marathon Foundation reserves the right to decide whether or not to hold the Tokyo Marathon 2023.
In the event of postponement, cancellation, or change in the method of holding the Race, including a reduction in the size of the Race, neither ASICS nor ASICS Group will refund any payment, and we will not be liable for any compensation for damages.
Any expenses not specifically mentioned herein are not included as part of the Prize and are solely each Recipient’s responsibility. All taxes or fees on the Prize, if any, are the sole responsibility of each Recipient, each Recipient bears all risk of loss or damage to Prize after it is released to Recipient or after it is placed by ASICS with a third party common carrier for shipment to Winner. Prize will not be replaced if lost or stolen and is not redeemable for cash, unless required by law. No substitution allowed, except at ASICS’ sole discretion, a prize of equal or greater value may be substituted.
General Terms and Conditions:
- The Gift is administered by ASICS Runner App, Inc. d/b/a Runkeeper, 125 Summer Street, Fl. 2, Boston, MA 02111 (“Runkeeper” or “ASICS Runkeeper”).
- The Gift must be collected by November 25th, 2022 23:59 (JST)
- Recipient must be at least 18 years old or the age of majority in such individual’s state or country of residence (please see the list of countries above), whichever is older, at the time of selection.
- ASICS or its regional ASICS entity will contact the selected Recipient by November 21, 2022, via the email address associated with your OneASICS account. In the event that ASICS Runkeeper cannot for any reason get in contact with a Recipient, or a Recipient rejects or does not confirm its acceptance or provide the email address, in writing, via email, to the initial communications within three (3) working days, ASICS Runkeeper reserves the right to select another Recipient
- In case the Recipient rejects the Prize after the acceptance, he or she shall bear any administrative costs incurred by ASICS Runkeeper and the cancellation fees / change of name fees. For the avoidance of doubt, there are no cash or any other alternative.
- In ASICS’ Runkeeper sole discretion, disqualification, forfeiture and the selection of an alternate Recipient may result from any of the following: (1) a potential Recipient’s failure to respond to notification promptly upon receipt; (2) a potential Recipient’s failure to provide ASICS Runkeeper with satisfactory proof of age, identity and residency.
- No cash redemptions or Prize substitutions allowed. The Prizes, or any unused portion thereof, cannot be returned, are non-transferable or exchangeable and cannot be taken as cash.
- If for any reason any aspect of the Giveaway event is not capable of running as planned, including by reason of infection by computer virus, telephone network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of ASICS Runkeeper, ASICS Runkeeper reserves the right at its sole discretion to cancel, terminate, modify or suspend the Give Away, or invalidate any affected entries, subject to the approval of the relevant government authorities, if required.
- ASICS Runkeeper reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or operation of ASICS Runkeeper or to be acting in violation of these Give Away Rules or in an unsportsmanlike or disruptive manner.
- ASICS’ Runkeeper decisions as to the administration and operation of the Give Away and the selection of the potential winners are final and binding in all matters related to the Give Away and are not open for discussion with ASICS Runkeeper.
- ASICS Runkeeper (including its group companies, their officers, directors, employees and agents) shall not be liable (including for negligence) for any personal injury or any loss or damage otherwise arising out of or in connection, directly or indirectly, with this Give Away, the Prize(s) or technical difficulties or equipment malfunction (whether or not under ASICS’s Runkeeper control).
- Except for any liability that cannot be excluded by law, by participating in the Give Away, all Recipients agree to release and hold harmless ASICS Runkeeper, its subsidiaries, affiliates, partners, agents, successors, assigns, each of their officers, directors, employees and agents, from and against any claim or cause of action, including, but not limited to, (a) Prize claims that contain inaccurate information or do not comply with or violate these Give Away Rules; (b) Prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) participants who have committed fraud or deception in entering or participating in the Give Away or claiming the Prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the participant to accept the Prize for any reason; (f) if a Prize cannot be awarded due to cancellation, delays or interruptions due to Act of God, natural disasters, terrorism, pandemic, weather or any other similar event beyond ASICS’s reasonable control; or (g) any damages, injuries or losses of any kind caused by the Prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of the Prize or resulting from participating in the Sweepstakes or prize related activities.
- ASICS Runkeeper will not respond to any inquiries regarding individual’s Give Away status or result. In case of any other inquiries or complaints about the Give Away, please send an email to asics.promotion@asics.com. If you have not been contacted by ASICS Runkeeper on or before November 21, 2022, you are not a Winner.
- ASICS Runkeeper reserves the right to modify these Give Away Rules at any time without prior notice for the sole purpose of ensuring the good execution of the Give Away, with no detrimental effect on Recipient.
- These Give Away Rules shall be governed by and be interpreted in accordance with the laws of Massachusetts and any disputes arising out of the Give Away shall be subject to the exclusive jurisdiction of the District Court of Boston, MA.

ASICS Tokyo Marathon キャンペーン（以下、「キャンペーン」）は株式会社アシックスと株式会社ランキーパー（以下、「ランキーパー」）が実施/主催するキャンペーンです。
エントリー
キャンペーンは、日本の居住者で18歳以上のランキーパーのマーケティングチームにより選ばれたハイアクティブなRunkeeperユーザー（ランキーパーの取締役、役員、管理職、従業員、その他のスタッフ、それらの家族を除く）に公開されています。
賞品
厳正な抽選で4名様が当選となり、2023年3月5日に開催予定の2023年東京マラソン（マラソン：一般）の参加権を贈呈いたします
当選者には、2022年11月21日までにOneASICSのアカウントに登録されたメールアドレス宛に電子メールでご案内いたします。 このメールには、東京マラソン 2023へのエントリー方法が記載されています。
当選者であっても、指定された期限までに申し込みいただけなかった場合は、本大会への参加権を喪失します。
本大会への参加申し込みの手続は、当選者ご自身で行っていただく必要がございます。
本大会の参加資格を満たす必要があります。参加資格は東京マラソン2023大会公式ウェブサイトでご確認ください。
本大会の開催については、東京マラソン財団の判断に従います。
本大会について、延期、中止または規模縮小を含む開催方法の変更等があった場合、ランキーパー及び株式会社アシックス及びそのグループ会社は、代金の払戻し等は行わず、損害賠償責任を一切負いません。
本大会の参加費についてはランキーパーが負担いたします。ただし、参加費以外の費用（本大会会場までの交通費、宿泊費など）は含まれておらず、当選者ご自身のご負担になります。
当選者ご自身の事由による本大会当日の不出走について、ランキーパーは一切の責任を負いかねます。
ランキーパーは独自の裁量により、同等またはそれ以上の価値のある賞品に代えることができます。
一般条件
- キャンペーンは、株式会社アシックスと株式会社ランキーパー（d/b/a Runkeeper, 125 Summer Street, Fl. 2, Boston, MA 02111 (以下、「ランキーパー」) によって運営されます。
- 賞品は、2022年11月25日 23:59 (CET) までに受領される必要があります。
- 参加者はキャンペーンに参加する時点で18歳以上、またはその個人の居住する国である必要があります。
アシックスまたは地域のアシックス法人は、2022年11月21日までに、当選者に対し、OneASICSアカウントの電子メールアドレスを通じて、ご連絡します。ランキーパーが何らかの理由で当選者と連絡を取ることができない場合、または当選者が3営業日以内に最初の連絡に対して、電子メールによる書面での承諾またはメールアドレスの提供を拒否または確認しない場合、ランキーパーは同じ当選者選択プロセスによって別の当選者を選択する権利を有します。別の当選者の選択は各ビブにつき最大3人の当選者とします。当選者がそれぞれの期間（3営業日）内に賞品を請求しない場合、当選者は賞品を請求する権利を失い、ランキーパーは当選者に対していかなる補償も行いません。
- 当選者は賞品の受領を拒否した場合、当選者はランキーパーに発生する事務費用およびキャンセル料・名義変更料等の負担について請求されることがあります。
- 当選者が以下のいずれかに該当する場合、ランキーパーは独自の裁量により、失格、没収、および代替当選者の選定することとかあります。
(1)当選候補者が通知を受領後速やかに対応しなかった場合、(2)当選候補者が年齢、身分証明、居住地の十分な証明をランキーパーに提供しなかった場合。 - 賞品またはその一部分の、返品、譲渡、交換、現金化はできません
- コンピュータ・ウィルスの感染、通信機器の故障、バグ、改ざん、不正な介入、詐欺、技術的障害、またはアシックスの制御を超える原因など、何らかの理由でキャンペーンイベントを計画通りに実行できない場合、ランキーパーは独自の裁量でキャンペーンをキャンセル、終了、変更、中断し、必要な場合は関係政府機関の承認に従って、影響を受けた応募を無効とする権利を持ちます。
- ランキーパーは、独自の裁量により、応募プロセスまたはランキーパーの運営を改ざんし、本キャンペーン規約に違反し、非スポーツマン的または破壊的な方法で行動していると認めた個人を失格とする権利を留保します。
- キャンペーンの管理、運営および当選者の選定に関するランキーパーの決定は、キャンペーンに関連するすべての事項において最終的かつ拘束力を持ち、当選者はランキーパーと協議することはできません。
- ランキーパー（そのグループ会社、その役員、取締役、従業員および代理人を含む）は、このキャンペーン、賞品または技術的な問題や機器の故障（ランキーパーの管理下にあるかどうかを問わない）から直接的または間接的に生じるいかなる人身事故またはいかなる損失や損害に対しても（過失を含む）責任を負わないものとします。
- 法律で除外できない責任を除き、キャンペーンに参加することにより、すべての参加者は、ランキーパー、その子会社、関連会社、パートナー、代理人、後継者、譲受人、それぞれの役員、取締役、社員および代理人を、以下を含むがこれらに限定されないあらゆる請求または訴訟について免責することに同意するものとします：（a）正確ではない情報を含み、これらの応募規約を遵守または違反している賞品要求。(b) 紛失、遅延、不完全、判読不能、破損、またはその他あらゆる種類のコンピュータ、人間または技術的エラーにより、意図した受取人に全部または一部が受け取られなかった賞品請求または通知。(c) キャンペーンに応募、参加、または賞品を請求する際に詐欺または欺瞞を犯した参加者 (d) 電話、電子、ハードウェア、ソフトウェア、ネットワーク、インターネットまたはコンピューターの誤動作、故障または困難 (e) いかなる理由でも参加者が賞品を受け取ることができないこと。(f) 天災、自然災害、テロ、パンデミック、天候、その他ランキーパーの合理的支配を超える同様の事象による中止、遅延、中断のために賞品を授与できない場合 (g) 賞品に起因する、または賞品の授与、受領、所有、使用、誤用、損失、誤配、キャンペーンまたは賞品関連活動への参加に起因する損害、負傷、損失 (h)賞品に起因するあらゆる種類のもの。
- ランキーパーは、個人のキャンペーンの状況や結果に関する問い合わせには一切応じられせん。キャンペーンに関するお問い合わせや苦情は、Marketing@Runkeeper.com までお願いします。なお。2022年11月21日までにランキーパーからの連絡がない場合はご当選者ではないことご承知おきください。
- ランキーパーは、キャンペーンの円滑な実施を目的として、いつでも予告なく本キャンペーン規則を修正する権利を有します。
- 本キャンペーン規則はマサチューセッツ州法に準拠し、それに従って解釈されるものとし、本キャンペーンに起因するいかなる紛争もマサチューセッツ州ボストンの地方裁判所の専属管轄権に服するものとします。
