ASICS takes your privacy seriously and is committed to handling your\r\n personal data in a way that is fair and worthy of that trust. ASICS will take\r\n all reasonable steps to protect your information from misuse and keep it\r\n secure. We believe it is important to inform you about how we will use your\r\n personal data. This privacy policy applies to all personal data that is collected and\r\n used by us when you create an ASICS ID account or another ASICS account, when\r\n you visit or use the websites, applications, web shops, online, mobile, instore\r\n or other services of ASICS (‘Services’), when you purchase our products in our\r\n stores, participate in events or contests of ASICS or interact with us through\r\n social media or otherwise. For purposes of this privacy policy, ‘personal data’\r\n means any information through which we can identify you, as further described\r\n below in ‘Personal Data We Collect’.
\r\n \r\nASICS is an international athletic equipment company, with headquarters\r\n in Japan and establishments worldwide. Our name is an acronym for the Latin\r\n phrase Anima Sana In Corpore Sano (sound mind and sound body). ASICS was\r\n founded on the belief that sports is the best way to create sound mind and\r\n body. Our brands include ASICS, ASICS Tiger, Onitsuka Tiger, Haglöfs and\r\n Runkeeper.
\r\n \r\nASICS Corporation, 7-1-1, Minatojima-Nakamachi, Chuo-ku, Kobe 650-8555\r\n Japan is responsible for using your\r\n personal data, together with other ASICS companies, such depending on where you\r\n live and which of our products you are purchasing or which of our Services you\r\n are using. An overview of the applicable responsible ASICS companies as well as\r\n their representatives and when they will be using your personal data can be\r\n found here.\r\n ASICS Corporation and the applicable responsible ASICS company will be referred\r\n to hereafter as ‘ASICS’ or ‘we’.
\r\n \r\nThe information we collect about you when you buy our products or use our\r\n Services may include the following (jointly referred to as: ‘personal data’).

We also collect information you voluntarily provide to us in relation to\r\n your physique, condition or nutrition in order to customize and enhance your\r\n experience when using our products and Services. These personal data may – by\r\n itself or in combination – reveal information about your (physical) health.\r\n The special categories of personal data include:

In addition, when using our Services,\r\n we may also collect and use exact information regarding your location,\r\n such as GPS, accelerometer, your running route (including precise location data\r\n that shows your geographical position).
\r\n \r\nWe will only use health and location data you voluntarily provide us and\r\n such only with your prior consent or under your direction to do so and only for\r\n the purposes set out in this Privacy Policy. You may refuse or revoke your\r\n consent at any time, as set out below (see ‘Your Rights’).
\r\n \r\nASICS collects and uses your personal data for\r\n the purposes set out below. Please be informed that insofar ASICS already holds\r\n information about you, ASICS may use that information for the same purposes.
\r\n \r\nIn order to manage and\r\n handle your purchases (online and in our stores) and to provide you with the\r\n Services you requested from us, including handling your requests, we use your\r\n contact details, your account and electronic identification data, information regarding your\r\n purchases in our stores and online, information regarding your\r\n leisure activities, interest and events, information regarding your\r\n training and running data (including your fitness activities), your\r\n Contest data, your communication data and – after your consent thereto – information\r\n regarding your Personal measurement, your running specifics, your tests, measurement\r\n results, and your location data.
\r\n \r\nAny information referred to\r\n above in the section ‘Personal Data We Collect’ may be used to\r\n maintain appropriate business records, to comply with lawful requests by public\r\n authorities and to comply with applicable laws and regulations or as otherwise\r\n required by law.
\r\n \r\nWe will use your contact details to send you newsletters\r\n or general\r\n marketing materials as well as surveys about Products\r\n and Services you have purchased. At any time, you may opt out of receiving\r\n such marketing materials by following the instructions in any communication you receive from us.\r\n You can also control these preferences in your profile settings and device.
\r\n \r\nWe will use the personal\r\n data referred to above in the section ‘Personal Data We Collect’ in order to improve\r\n our products and Services as well as to understand our customers both on an\r\n aggregated and on an individual basis. In order to do so, we may combine the\r\n data we have obtained about you from the different ASICS entities that have\r\n collected your personal data (if applicable). This also means that we analyse\r\n your use of our products and Services and we use this information to improve\r\n our products and Services and to give you a better user experience (e.g., we\r\n analyse what web pages you visit, which products and Services you use and like,\r\n how you use these products and Services, which enables us to create personal\r\n profiles and to assess what may be interesting to you, which recommendations we\r\n can give you when you purchase our products or use our Services (such based for\r\n example on your previous purchases and use of our Services)). Creating such\r\n personal profiles of our customers, also enables us to send you marketing\r\n materials that directly relate to your use of our products and Services, if you\r\n have chosen to receive such materials.
\r\n \r\nWe may also enrich your\r\n personal data with data from other third party sources, such as weather\r\n forecasts based on your location (expected temperature, humidity, wind) and\r\n traffic forecasts (chance of air pollution), for example to further customize\r\n your training plan, allow you to adjust a specific run to the concrete\r\n circumstances or provide you with more detailed information about your runs.

We may use the personal data\r\n referred to above in the subsection ‘Special Categories of Personal Data’ (i.e.\r\n health data and location data) for the purposes set out in this ASICS\r\n Privacy Policy but we will only do so after we have received your consent\r\n thereto.
\r\n \r\nWe may use your personal data referred\r\n to above in the section ‘Personal data we collect’\r\n for marketing purposes based on your profiles via\r\n email, SMS, other electronic means or otherwise, but we will only do so after\r\n we have received your consent to do so.
\r\n \r\nWe also use your personal\r\n data referred to above in the section ‘Personal data we collect’ based on your consent, if you subscribe to receiving our\r\n newsletters or participating to our surveys.

In providing their\r\n services, they can access, receive, maintain or otherwise process personal data\r\n on our behalf. Our contracts with these service providers do not permit use of\r\n your information for their own (marketing) purposes. Consistent with applicable legal requirements, we\r\n take commercially reasonable steps to require third parties to adequately\r\n safeguard your personal data and only process it in accordance with our\r\n instructions.

Notwithstanding anything else in this Privacy\r\n Policy, we may share aggregate or de-identified information with third parties\r\n for research, marketing, analytics and other purposes, provided such\r\n information does not identify a particular individual.
\r\n \r\nWe and our third party providers use cookies, clear GIFs/pixel tags,\r\n JavaScript, local storage, log files, and other mechanisms to automatically\r\n collect and record information about your browsing activities, and use of the\r\n Services. We may combine this “activity information” with other personal data\r\n we collect about you.
\r\n \r\nGenerally, we use this activity information to understand how our\r\n Services are used, track bugs and errors, improve our Services, verify account\r\n credentials, allow logins, track sessions, prevent fraud, and protect our\r\n Services, as well as for targeted marketing and advertising, to personalize\r\n content and for analytics purposes. When you participate in various social media\r\n forums like Facebook, Twitter, Yammer, Pinterest, Instagram, LinkedIn, etc.,\r\n you should be familiar with and understand the tools provided by those sites\r\n that allow you to make choices about how you share the personal data in your\r\n social media profile(s).
\r\n \r\nASICS is bound by the privacy practices or\r\n policies of these third parties, so we encourage you to read the applicable\r\n privacy notices, terms of use and related information about how your personal\r\n data is used in these social media environments.
\r\n \r\nAlso, depending on the choices you have made\r\n regarding your settings on various social media sites (and/or in combination\r\n with your settings on the ASICS pages), certain personal data may be shared\r\n with ASICS about your online activities and social media profiles (e.g.\r\n interests, marital status, gender, user name, photo, comments and content you\r\n have posted/shared etc.).
\r\n \r\nOur online Services are not directed to children\r\n under 13 years of age. If you believe we\r\n have collected information about a child under the age of 13, please contact us\r\n (see ‘Data Protection Officer - Contact and Queries’ below) so that we may take\r\n appropriate steps to delete such information.
\r\n \r\nIf you are at least 13 but under 16 years of\r\n age, please get the consent of your parent or legal guardian before you give us\r\n any personal data about yourself. Your parent or guardian should contact the\r\n ASICS company responsible for using your\r\n personal data – the overview of the applicable ASICS companies can be found here and\r\n provide us with their name, e-mail address and any other identifying\r\n information that we may request. ASICS needs this information in order to\r\n verify that they have provided the necessary consent. We may follow up by phone\r\n or other means in some circumstances. If you are at least 13 but under 16 years\r\n of age, do not contact us or provide us with any personal data until after your\r\n parent or guardian has sent us an e-mail consenting to your contact and provision\r\n of such information.
\r\n \r\nPlease be informed that we transfer and process any personal data you\r\n provide to us to countries other than your country of residence. The laws of\r\n these countries may not afford the same level of protection to your personal\r\n data. ASICS will therefore seek to ensure that all adequate safeguards are in\r\n place and that all applicable laws and regulations are complied with in\r\n connection with such transfer. More in particular for data transferred from\r\n the EU to countries outside the EU, ASICS is using Intra Group Data Transfer\r\n Agreements based on EU Model Clauses.
\r\n \r\nASICS will take reasonable steps to ensure that your personal data are\r\n properly secured using appropriate technical, physical, and organizational\r\n measures, so that they are protected against unauthorised or unlawful use,\r\n alteration, unauthorised access or disclosure, accidental or wrongful\r\n destruction, and loss. Your personal data will be retained for as long as\r\n required for the above purposes or in so far as such is necessary for\r\n compliance with statutory obligations and for solving any disputes.
\r\n \r\nASICS retains your personal data for as long as required to satisfy the\r\n purpose for which they were collected and used (for example, for the time\r\n necessary for us to send you the newsletters you subscribed to, to provide you\r\n with customer service, answer queries or resolve technical problems, etc.),\r\n unless a longer period is necessary for our legal obligations or to defend a\r\n legal claim.
\r\n \r\nIf you have created an ASICS ID account or another ASICS account with us,\r\n we will delete that account and your personal data upon your request or 30 days\r\n after it has become inactive. We will consider your account ‘inactive’ when you\r\n haven’t used your ASICS ID account or another ASICS account for a period of 2\r\n years. Before your account becomes inactive, we will notify you to use your\r\n ASICS ID or another ASICS account to prevent your account from being\r\n inactive. When we cancel your account, your personal data will be deleted, such\r\n with the exception of your account data and your training and running\r\n data in case you are using the RunKeeper app, which data will be stored for an\r\n additional 4 years after your account becomes inactive (unless you ask us to delete\r\n your data earlier). Also, if we need to store certain types of your personal\r\n data for a longer period due to legal requirements, we will store such data in\r\n accordance with the mandatory periods.
\r\n \r\nYou have the following rights concerning your personal data: right of access, right of rectification, right to erasure, right to restrict data processing, right to object against profiling and your right to data portability. \r\n \r\nTo the extent that we are relying on our legitimate interests to use your\r\n personal data, you also have the right to object to such use (unless we can\r\n either demonstrate compelling legitimate grounds for the use that override your\r\n interests, rights and freedoms or where we need to process the data for the\r\n establishment, exercise or defence of legal claims).
\r\n \r\nWithout undue delay and not later than within a month, we will respond to\r\n your request to invoke your rights consistent with applicable law.
\r\n \r\nYou may revoke your consent for receiving\r\n marketing communications at any time, free of charge by following the\r\n instructions in any marketing communication. You can also control these\r\n preferences in your profile settings. ASICS will then stop applying the\r\n research results to you at an individual level and will stop sending you\r\n marketing communications.
